These Terms and Conditions (“Terms”) govern the Money-Back Guarantee & Store Credit Policy (“Guarantee”) offered by Start My Business Inc. (“Company,” “we,” “our,” or “us”) to eligible clients (“Client,” “you,” or “your”). By enrolling in our programs or services and seeking to rely on the Guarantee, you agree to be bound by these Terms.

1) Overview of the Guarantee

If your total business credit approvals (including limits, lines, and cards obtained through our guided process) do not exceed your initial investment paid to Start My Business Inc. for the applicable program, we will issue a refund of your program fee as store credit only. No cash or direct monetary refunds are provided under this Guarantee.

• Store credit may be applied toward any Start My Business Inc. services, upgrades, or future programs.
• Store credit is non-transferable, cannot be sold or exchanged for cash, and expires twelve (12) months from the issuance date.

2) Eligibility Requirements

To qualify for this Guarantee, you must complete all of the following actions that we cannot complete on your behalf (unless separately purchased where available):

• Business Verification: Verify your business address and phone number with a notary. (If you use a Nominee Director service available on our Do-It-Yourself page, this may be performed for you.)
• Business Banking: Open at least one business checking account in the company’s legal name. We provide step-by-step guidance and checklists.
• Tier-One Vendor Applications: Apply to 3–5 Tier-One vendors (e.g., net-30 accounts) that report to business credit bureaus, for the purpose of establishing a PAYDEX® score with Dun & Bradstreet.
• Trade Lines Reporting: Ensure you have at least 2–3 active Net-30 tradelines (e.g., Uline, Quill, Summa, Grainger, NAV) reporting on your business credit profile.
• Active PAYDEX Score: Maintain an active Dun & Bradstreet PAYDEX® score (i.e., sufficient tradeline activity for D&B to generate and display your score).
• Vendor Application Strategy: Do not submit multiple applications to the same credit bureau on the same day unless stacking inquiries strategically. Excessive same-day inquiries can reduce approval odds. If you prefer a fully managed process, consider our done-for-you option below.
• Personal Credit Baseline: At enrollment, maintain a personal credit score of at least 580 across Equifax, Experian, and TransUnion.

3) Exclusions & Limitations

• Failure to complete any eligibility requirement in Section 2 disqualifies a claim.
• We do not guarantee approvals from any specific lender, vendor, or amount; approvals are made at the sole discretion of third-party institutions.
• The Guarantee does not cover indirect, incidental, or consequential losses, lost profits, or opportunity costs.
• Store credit may be applied only to Start My Business Inc. offerings and cannot be combined with resale or transferred to another person or entity.
• Claims related to misuse, misrepresentation, or fraud are void.

4) How to Submit a Claim

To initiate a claim under this Guarantee, you must:

1. Provide documentation demonstrating completion of Section 2 steps.
2. Provide evidence of credit applications, business bank account opening, and all approvals obtained (or denials received).
3. Email a written claim to support@startmybusiness.us within ninety (90) days of program completion or within twelve (12) months of purchase—whichever occurs first.

We may request additional information reasonably necessary to verify eligibility. If approved, store credit equal to your original program fee will be issued to your client account profile.

5) Our Commitments

We perform approximately 90% of the program work—entity setup, compliance preparation, bureau alignment, and lender-ready packaging. You are responsible for the essential actions only you can complete (Section 2), unless you purchase additional services where we can legally act on your behalf.

6) No Warranties Beyond This Express Guarantee

Except for the express Guarantee stated herein, Start My Business Inc. disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Results vary by client, compliance profile, and market conditions.

7) Limitation of Liability

To the fullest extent permitted by law, in no event shall Start My Business Inc., its affiliates, officers, directors, employees, contractors, or agents be liable for any incidental, indirect, special, consequential, exemplary, or punitive damages, or for lost profits, business interruption, or reputational harm. Our aggregate liability arising out of or related to this Guarantee shall not exceed the total value of the store credit issued under this Guarantee to you.

8) Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. The exclusive venue for any dispute arising out of or relating to these Terms shall be the state or federal courts located in Laramie County, Wyoming, and you consent to personal jurisdiction therein.

9) Intellectual Property & Third-Party Marks

PAYDEX® is a registered trademark of Dun & Bradstreet. All third-party names and marks are the property of their respective owners. Reference to third-party services or vendors does not imply endorsement or affiliation.

10) Miscellaneous

• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
• Entire Agreement: These Terms constitute the entire agreement regarding the Guarantee and supersede prior or contemporaneous communications.
• No Waiver: Failure to enforce any provision shall not be deemed a waiver of that or any other provision.
• Changes: We may update these Terms from time to time; the “Last Updated” date will reflect the most recent version. Continued enrollment or reliance on the Guarantee constitutes acceptance of changes.
